This was I think a great use of in game logic to justify the removal of these very useful items.
Maybe not: it could be perceived as heavy-handed.  Alternatively if you did that and then still had them used illegally you can get near to the effect and have a good flavor as well.

Once I had to climb the Oblivion Towers I understood why they took flight out of the game. It would have made the Towers easy to beat. But I would also like to add that b/c flight was no longer available I turned to Invisibility Spells and later enchanting invisibility effects on armor so I never had to fight if I didn't want to. Made those towers easier b/c now I wasn't being chased all the dang time.

So the game forced me to adapt or fail. If other OGL games felt flight unbalancing, why even give options for it. Take it out and let people adapt. Or was flight just one of those options you couldn't do without, as per the Ivory Tower Design Philosophy? http://www.montecook.com/cgi-bin/page.cgi?mc_los_142

Also, the cities are independant cells to the rest of the map, so if you fly over the walls you fall into nothingness (or perhaps, you fall into oblivion... Wink).  On the other hand, Morrowind cities were part of the overland cell and loaded with them.  That said - flight in Morrowind was pretty broken, my wizard (and archer with a magic item of levitate) was untouchable by most enemies since almost no monsters had ranged attacks and the only fliers were just annoying, rather then threatening.
